Obligation of ISP if a user is sending spam/trojans

Obligation of ISP if a user is sending spam/trojans

I have been receiving trojans (going into my spam filter account) from a netvigator address. Is there any obligation on the ISP(Netvigator) to do anything eg close account etc if this is reported to them, or do you have to rely on your own filters.

I appreciate that if one account is closed the spammers probably just open another....

Probably spoofed. Is it coming through the netvigator SMTP server?

I'd be surprised if they do anything ... their reaction time tends to be 48 hours ...

Some ISPs have a policy of disablingzombies. However, are these spams you receiving simply "return address" of netvigator, or did you track the IP address of the SMTP server sending the email to netvigator? If the latter, then send an email to abuse@whatevertheisp.com, if just a faked email address, you are kind of out of luck until more sender verification systems are enabled.

It doesn't hurt to let them know about it.

Getting Virus or Trojan's has nothing to do with the ISP, in fact if you complain to an ISP because you got a virus or trojan from abc@domain.com, you most likely complaining to the wrong ISP as the Virus/Trojan's fake their sender address.

The only way to find the origination of the sender is to look at the message headers which will show senders IP. Then find out who the IP address using a WHOIS service and then email to their ABUSE address listed on the whois record.

The ISP is unlikely to do anthing as they will have to find out at what time who was using the IP address you are complaining about. After that then they have to get the user to remove the virus. Most people won't bother to update their anti-virus software or pay for the updates.

Another thing you could do is get an anti-virus service from your ISP or use a mail service that provides AV/Trojan/ Anti-phishing.
