HK Employee Laws

I am trying to find out what the local HK laws are regarding employees.

For example:

1. if someone is hired, when does the vacation allowance start, and how many days do they get.

2. do vacation days build on after x amount of years?

3. if someone is fired, what is the compensation given by employer?

4. if someone wants to quit, what is the required notice?

In what context are you asking these questions? Are you not allowed to take vacation days? Are you in danger of being fired?

All of these questions should be included in the terms of your employment, i.e. your contract. The HK labour laws would only have VERY minimal protection.

its not for me...its for the HK staff.....

i am just trying to help solve some disputes in the office...and help out the HQ with decisions...

so i just wanted to know the local laws for these points

This is from my personal experience with a number of small local HK companies, i.e. less than 10 employees:

1. The first 3 months is on probation, but the employer may give you advanced leave on a discretionary basis. Typically, for such firms, the annual vacation leave is about 12 days (one day for each month worked). They may also allow annual leave on a prorata basis.

2. Supposedly, we got one additional day for every year worked. However, some companies will start counting from the second year onwards.

3. Usually, there is no compensation for being fired (supposedly, owing to misconduct or breach of contract). However, if you are made redundant or laid off, the company must compensate you according to the labor laws (there is a formula).

4. If someone wants to quit within the first week (or month - I can't remember exactly), 1 days' notice is required. Otherwise, within the probationary 3 months, 1 weeks' notice is required. After probation, you must give 1 months' notice unless your contract states otherwise.

You should double check with the Labour Department's website. The department also publishes a pamphlet every few years on the employment ordinance.

The Labour Department here: http://www.ld.gov.hk/english/statutoryduties/cap057.htm has some fairly clear guidance on the Employment Ordinance.
