thanks for the fast reply.
I fall into this category:
c) a person of Chinese nationality born outside Hong Kong before or after the establishment of the HKSAR to a parent who, at the time of birth of that person, was a Chinese citizen falling within category (a) or (b).

Will I definitely be accepted? because i heard from a friend that he went to hk in 2003 and sent in his application there, but he only just got approved!

also is there a difference between hong kong identity card and personal identity card? or are they the same thing?

thx

P.S the application form isnt available for download online?

Hi,

you can only apply for an overseas ID if you are also applying for the Hong Kong SAR passport (and that you don't already have a HK ID).

1) To qualify for the passport (and the overseas ID)- you need to be a Chinese citizen.

2) About the overseas ID: as HKSAR passport holders MUST hold HKID by law, this means that those who wish to apply for the passport, but have not yet got the HKID, must also apply for HKID. For those who are applying overseas- they will be issued an overseas ID card- this card must be renewed within 30 days after the holder arrives in HK.

THUS- if all you want is the HKID card, applying for the overseas ID card would not be useful for you. (Criteria for applying HKID cards: pls see www.immd.gov.hk)

I believe you can only qualify to fall into this category if you are under 18 years of age. That is, if your parents have a permanent HKID card and you are trying to piggy back off of that. Once you reach 18, then you will need to qualify on your own - in your case, it would be continuously living in HK for 7 years. I'm pretty sure this is true, but do double check with immigration.

About Art 24(2)(3) of the Hong kong Basic Law- ((( I fall into this category:

"I believe you can only qualify to fall into this category if you are under 18 years of age"---- NO,

if you are of CHINESE nationality (i.e. you're a Chinese citizen, better if you were a Chinese citizen AT THE TIME OF BIRTH), you should qualify for HKPR status, regardless of your present age.

This is different from NON-CHINESE citizens who wish to qualify as HKPR. Under Art 24(2)(5) of the Hongkong Basic law, a non-Chinese citizen may qualify as a HKPR, if he/she was born in HK to non-Chinese parents who are HK residents, AND he/she is under 21 years old.

However, if you are Chinese, Art24(2)(5) does NOT apply to you. Whether or not you are a HKPR then would depend on whether you satisfy the requirements under Art 24(2)(1)-(3) of the basic law:

i.e.
(a) born in HK
(b) settled in HK for 7 years continuously
(c) born outside HK to parents, one of whom is mentioned in (a) or (b)

Also, try emailing the Immigration Dept of Hongkong (enquiry@immd.gov.hk). The Chinese embassies overseas usually do not reply to you very quickly
