| Overstay Lived continuously in HK for 7+ years on an employment visa, then overstayed a significant period after expiry. Was not employed / receive wages during the overstay period. Also have a child with my unmarried spouse - both were born in HK and are HK citizens. Want to fix the overstay and apply for longer-term resident status, possibly unconditional stay. Wonder how best to approach HK Immigration Dept. Q: Does the overstay negate the 7-year residence qualification? Q: Does my child's citizenship improve my request for residence? Q: Will I need to leave the territory to reapply? Thanks in advance to anyone offering helpful comments. |

| hello The overstay does effect your application and you need to prove your continuous stay in HK for the period of 7 years. If you want me to evaluate your case please let me know via a pm. |
