Is this right or even legal?

I have a quick question that is pretty complicated. I just started work for a fairly well known F&B group, I was checking up on my resigned staff from last month regarding pay and the tips they are entitled to. There are two kinds, cash and credit tips. I was informed by an accountant that the company is not going to release the credit tips to the former staff, It is going right to the "company" In my eyes even though it might not be much money, some only $400 or so, but these people worked for it. And they deserve to get it right? Being the new guy I dont want to pet the cat backwards right away and raise to much hell. Advice please? Can they do this?

Surely it depends on what the contracts with those workers who resigned says on this issue...

If they're well known, they probably have a simple employee contract or offer letter. What does that say?

I can tell you, having chatted with several bartenders and floor staff... there is nothing worse than an employee running into a regular of the old establishment and bad mouthing how they screwed him out of his tips when they left. (Assuming that they were the friendly types who took the time to recognise the regulars...)

To be on the safe side, I'd send the Labour department a very discrete email.
