Question I have been working in HK with no HKID

now for 3 months but signed a contract for a position in Shenzhen. The European Company I work for promised to get me an HKID when they demanded I work here rather than PRC.

My contract period is up next week and I do not want to continue this way working illegally. (is my employer in more trouble than me?)

I would like someone to recommend a lawyer to me who might sue this company for breach of contract and split the settlement with me if there is a chance of winning.

aren't you supposed to get the HKID on your own? That's how I understand it-- you actually need to go and get the ID yourself... correct me if I'm wrong though

If you have been working as a visitor for a company in Hong Kong and without an employment visa then you and your employer will be held responsible.

It is best that you secure the correct legal status for Hong Kong as soon as possible depending if you are just visiting or working.

i wouldn't be worried about suing them. you have been acting illegally yourself and are liable for that. if you broadcast that fact through a lawsuit, immigration will no doubt find out, and you will suffer the consequencesse.

When you come back to HK from SZ, you should definitely apply for HKID if you are staying in HK for over 90 days. Very important!

If this is the first time Visa to the US then I am not very sure considering that your HK visa is valid only for 5 months.. But on the other hand if you have your Company letter saying the purpose of the visit and the invitation letter from US then you might be able to get it from here.. But even for an interview you need to go pay HK$ 800 and no re-imbursement if you don't get your visa.

I used to work illegaly too! They won't find out... as long as your employer or your co-workers don't tell.
