Request for Evidence from HK Immig I have a client who has received a Request for Evidence from the Immigration Department of Hong Kong. They filed employment applications for intracompany transfers who are U.S. citizens. The Request for Evidence seems pretty basic in the evidence requested, but I am concerned about the two week time frame. Could we withdraw the first employment applications without any prejudice and then refile the applications after they have entered Hong Kong as business visitors and then submit a change of status application or file them with the Chinese Consulate abroad before they travel to Hong Kong or do we have to respond to this Request for Evidence within the 2 week time frame?

They can enter Hong Kong as visitors while the work permits are being processed. They can pick up the visas in Hong Kong and exit and re-enter via Macau or Shenzhen. Not sure why you'd want to withdraw an application and restart the process.

Or maybe approach them for more time (say 2 extra weeks) if you can explain why.
