British nationality for Indian origin children born in Hong Kong

Recent changes to Indian citizenship law have important implications for children born in Hong Kong in cases where one parent is a citizen of India and the other parent is solely a British National (Overseas) or became a British Overseas citizen on 1 July 1997 (because they failed to register as a British National Overseas).

A child born in Hong Kong will now automatically be a British Overseas citizen at birth if:

1. the child is born in Hong Kong after 7 January 2004,
2. one parent is solely a citizen of India and the other parent is solely a British National (Overseas) or automatically became a British Overseas citizen on 1 July 1997,
3. neither parent is a Chinese citizen, and
4. the child has not acquired the citizenship of any other country at birth.

After establishing the claim to British Overseas citizenship, as long as the child continues to have no other nationality, the child will be entitled to registration as a full British citizen (with right of abode in the UK) under section 4B of the British Nationality Act 1981.

The 'Additional Notes' part of the website contains links to both the Indian Ministry of Home Affairs website as well as the UK Parliament website.
