Hello need some legal advice ...

just purchased a return ticket from HK to London with Air Zealand for 6112 HKD with Zuji travel agents on-line .. thought i got a brilliant deal got the confirmation email great ..!!

but apparently not ... there system fU**ed up so they rung me wanting another 2000 HKD as the price was wrong ... so what can i do legally ..

1) i guess they can't charge me the extra 2000 they want without my authorisation

2) can they just cancel the ticket and refund me?

3) or should they honour the original contract at the price offered ? seems they shouldn't punish the consumer just coz the price was labelled incorrectly ..

.. they do have a disclaimer saying the price is subject to change but my opinion is it pretty shabby business practice ..

what do you guys think?

Did they already take the HKD6112 from your credit card?

If so, then my feeling is that you have a contract which they have to honour.

I'd bet they have not charged the card, just taken an authorization and would charge the card once they've issued the ticket. If this is the case, they can refuse to proceed and not complete the transaction - mistakes happen.

If they've charged the card, then they should not be switching the price on you.

hmm, standard law of contract:

zuji advertising price: invitation to treat.

You agreeing to pay price: offer.

Zuji sending out confirmation email: acceptance.

Only thing left is performance - to be made by Zuji in the form of issuing you the ticket.

HOWEVER first you NEED to READ Zuji's terms and conditions on tickets AND the confirmation email.

It will state when Zuji have accepted your offer. Is it when you receive confirmation email, or some other point.

If its when you receive confirmation email, then Zuji don't have have leg to stand on and need to honour the contract.

Oh should add, something like this happened with my g/f.

She booked tix, and paid with T/A.

T/A issued tix, but then a day later turned round and said sorry, made a mistake, you owe us so much. If you don't owe us so much we will cancel your tix.

G/f ended up paying extra.

My advice in such situations would be, sorry, but contract already made. If you cancel tix, I'll take you to the consumer council (which incidentally can't really do much apart from apply some pressure to the T/A).

Unfortunately HK doesn't have decent consumer protection laws, so this sort of thing happens quite a bit.

yes thanks for the advice ...

yes know-it-all is correct they have only emailed confirmation that the payment has been processed and not actually deducted payment ..

so legally i think there entitled to change the price as they state "Prices ar not gauranteed until payment in full is recieved and your ticket is issued"

pin - since you seem to know a little about the matter - I was wondering what would happen if Zuji just sends a confirmation email saying "thanks for your purchase, we've billed you 8112HK$" then what?

Reason why I'm asking, I got myself into a bit of trouble when I flew home in June. Booked with Emirates nearly 8 month back in 2007. Paid with my German credit card. During the last year however more and more companies started to require you to bring the credit card used for payment to the airport, nowadays I think every airline does so (at least my next booking had such a pop-up). Now I was really really sure there hadn't been such a pop-up when I booked, but even if - what is my position against a company who said "you booked and confirmed this way, our system says so"? No such information was given in my confirmation email, but they didn't care, I had to get someone mail a photo of my cc (not that that would have been hard to forge).

update

well fair play to fuji. after a few days of me stalling and not answering there calls , i got a call from them saying they would honour the fare.

due to other cirumstances, I needed to cancel the flight anyway so have reneged on the deal and will be refunded without penalty ...

so a big plus for Fuji on this one ... nice one guys
