Exactly my point.
ANY reasonable person would expect to be informed in any conversation, if it where to be treated as a contract, the full details. Clearly and concisely. The person exacting that contract should ensure that the other party clearly understood all parts of that contract.

Assumption is too grey an area and terms MUST be clearly defined.

Any lawyer would fall on the position that the DUAL charging was not clearly defined. No judge would accept the premise that the customer would assume that. If you think that they would, then on what premise? No written terms have been supplied to the customer for their understanding as far as the OP has indicated.

Of course it might be argued that " Our terms and conditions are laid out in our literature and website ". In which case this position must be covered by a statement in conversation. " Have you seen and understood our terms and conditions laid out in our literature or on our website. " An affirmative on this would then cover the position of the supplier. As far as has been indicated here, none of that has happened.

Hi All,

Forgive me for not reading all the posts & the fact my situation was nothing to do with NOW tv or in fact in HK.

I faced a similar challenge prior to leaving UK, with one of the big mobile phone providers. I had been contacted,by phone call, by my "Account Manager" 18 months before my move (when we didn't know we would be coming to HK) & told I was on the wrong tariff & if I changed my package, my skyhigh phone bills would reduce. Instead of paying £40 p month & having bills of £500 (working abroad) I could pay £88 p month & my international calls would be cheaper. I was a bit suspicious but was told that as a loyal customer of several years the Account Manager was there for exactly this purpose. At the same time I was told I was entitled to any upgrade phone aswell. I accepted this offer & took a new Blackberry.

18 months on I serve my 1 month notice to cancel contract (as per original signed contract), as I'm moving to HK & phone is SIM locked to UK, effectively useless over here! I am told I cannot end contract unless I pay remaining 6 months of "verbal contract of 2 years", which I allegedly agreed to over the phone!

I stood my ground & maintain that the new "contract" terms & conditions were never explained to me, in fact I wasn't even aware I had entered into a new contract. Eventually, after many phone calls & threats of legal action from both sides I packaged up the Blackberry & sent it back, only prepared to pay my last bill. This was accepted & contract cut.

You have to stand your ground & be prepared for all the hassle. Also, I am now far more aware that these guys are SALES guys & it is there job to get you to sign for the high value contracts!!

If your apartment complex or house doesn't have fibre you're not going to get it. Which means you either have to wait or pay a lot of money to get it installed ahead of schedule.

I agree. NowTV quality and resolution is absolutely terrible. Too bad that you can't test it before you signup for it, or I would never have registered for the service.

As a Netvigator user I signed up for a 2 year contract with my internet, but the cable offer attached was split up into part 18 month part 24 month contract. Their site says once your channels expire they are automatically renewed, sometimes at a totally different price (ESPN/STAR Sports for example with the new Mega Sports Crap). Of course the company NowTV does not remind you of your 18/24 month contract about to expire. I have already called to cancel the 18 month channels that expire in June, but I have a funny feeling they are going to forget I ever called and start charging me for a whole new contract.

Also I requested to keep a few channels until September as I am possibly moving back to Canada. They said I was only able to sign a 12month or greater contract. I even offered to pay in full the remaining months of everything in one lump sum until the end of September. They didn't want my money. I was shocked.

I have also started to notice how NowTv is changing a lot of it's programs onto different channels that are part of a higher priced pack. ESPN and Star Sports show absolutely nothing, all the good events are taken off and put onto the high priced mega-sports pack. Also Lost Season 4 is not on AXN, it is being changed to AXN extended. This is a load of garbage, and I'm so greatful for Bittorent.
