.asia domains - trademark infringement abetting?

Was very surprised to see some well know trademark names being auctioned on the new .asia domain registry.

If you see your company's trademark in here .... FIRE your IP lawyer.

i know those guys well....

it is common for registrars to get involved in dodgy things when they are not hitting the sales figures.

It is better not to be known than to be doing dodgy things with public resources like domains.

It would be stupid to buy many of those auctioned names. There are pretty simple and inexpensive legal procedures to get domain names cancelled or transferred by the owner of the IP/ trademark rights to the name used in the domain name. Cybersquatting is becomming such a annoyance to companies lately. Arggg.

Even our beloved HKDNR started an Auction site with Yahoo, well until I called the SCMP. Probably write a nice scathing blog about that somewhere.

BUT the so called registry will profit from the transaction - clearly on gray area trademarks.

Running a registrar can be fun but most of the decisions, the right decisions tend to be ones that really don't favour you, the operator. Greed and shortsightedness always tries to get the best of you.

I think a far bigger issue when you open a registrar is the fact that everyone is racing for the valuable generic domains and then they get hogged and stored by people who wait for people to come and buy them off them, which rarely happens.

The best method of handling this is reserving all of them and when anyone wants to get one say business.xxx you don't charge them anything extra however, they have to submit a business plan, sample of the site, proof that it is actually going to amount to something.

Anyway .asia is dumb to say the least or any 4 letter hierarchy, many apps will not work with those domains.

To be fair there was a 3 month "advance booking" period where the .asia domains were available only to those who could demonstrate that they used the corresponding brand/company name. This was fairly well advertised at the time, so the registrar seems to have made a reasonable effort to avoid cybersquatting.

I agree with PDLM, also, from KIA's list only a few are blatant trademark issues (like pier1imports). I don't know of any domain registry that takes on the nightmare of trademark assessment and enforcement. They have to leave it to the existing copyright and judicial systems and the usual 'Cease & Desist' letter.

PDLM - absolutely. Which is why I said .. IP lawyer needs to get fired. There are some good services out there that can watch out for trademarks online ... pity to see a registrar reap profits from spammer scum.
