Questions regarding the procedure to get RTL

Hello,

I want to know if someone can help me with these questions:

1. My mother is born in Canton and has lived in Hong Kong for more than 20 yrs (she has a permanent HKID). My father is born in Suriname.

2. I am 28 years old and want to work in Hong Kong. (I live in the Netherlands at the moment).
From what I have understood from the Immigration website, I could apply for the right to Land ID. (or Not?!)

What kind of documents do I need for my application.
And does anyone has the same kind of history like mine?

Were you born in Hong Kong? (Or China?) Did your mother have HK Permanent ID when you were born?

I am born in Paramaribo. My mother did have the permanent HKID.

I need help from people who have done this... I'm not sure to be honest whether you can apply for Right to Land - I thought it was only something that you got if you would have been eligible for Right of Abode but have been away from HK for an extended period. I assume that you are a Suriname (or maybe Dutch?) citizen through your father and/or birthplace?

Of course, you could always just email Immigration and ask them: enquiry@immd.gov.hk

I am holding a Dutch passport by the way...

Your mother has lived in Hong Kong for over 20 years? You are 28. Are you sure she has been a Hong Kong Perm. ID holder for 28 years or longer? (Meaning she has actually been living in Hong Kong for 30+ years)

Tense confusion I think. I decided that she meant that her mother had lived in HK for 20+ years but perhaps before tjonlilian was born. I guessed that her mother hasn't been living in Hong Kong in the last 28 years.

But I may have misunderstood completely.

Don't quote me on this but I'm only basing this on my past experience in applying for ROA/RTL.

After I applied and sent in all the required documents, I got a letter from the IMMD mentioning that I would not be eligible for ROA but I will be given RTL based on the grounds that I was a British Dependent Territory Citizen by descent. If you were born before 1997

Your mother was born in Guang Zhou and immigrated to Hong Kong later on I presume. Your mother would still be a PRC citizen and not a British subject unless she naturalised. I'm not sure if you have to be a BDTC when you were born , but that was the reason why they approved me for RTL on my application at the time.

Sorry , I couldn't edit my last post in time.

All individuals born abroad to Hong Kong permanent residents who were BDTCs will have the Right of abode automatically as long they have established it before 1997 and have not been absent from Hong Kong for more than 36 months. I established mine after 1997 but they granted me RTL based on me being a BDTC by descent at the time I was born - therefore I once had the ROA but never established it.

I'm just not sure how it would work since your mom might not be considered a BDTC. People who moved to Hong Kong from China before 1997 are not eligible for BDTC passports unless they naturalise as British subjects. Does your mother have an old British Passport ? If she does, then that means she may have naturalised as a British subject and you may be eligible for RTL.

Again , this is just based on my knowledge and I'm basing this on my the information provided when I applied. I would still contact the IMMD and make sure. I hope this helps.

Thank you all for sharing.
I guess I should have been more precise.

My mom and I moved to Hong Kong in 1980 (because of the death of my father).
As I can remember I came to the Netherlands in 1984. My mom returned to Hong Kong where she is living now.
As far as I can remember, she used to have a British passport. I already asked her to copy it.

I hope I can get through the application to get my RTL.
