I had applied for the dependant VISA for my mother on the basis that she is a widow and there is nobody to take care of her back home. But, the immigration asked me to withdraw my application as I am not yet a permamnent resident and my mother is not over 60 years.

But, I know of few cases wherein the VISA has been given in similar circumstances.

Please let me know the process if anyone had success in getting the dependant VISA for their parents without being a permamnent resident.

This information would be of great help to me as I need to get my mom to HK on dependant VISA.

Why don't you ask the people involved in the "few similar cases" that you claim you know about?

I'm sorry to be blunt, but my experience with ImmD is that the rules are the rules. In this case there is really no ambiguity or room for interpretation - non-Permanent Residents cannot bring their parents to Hong Kong as Dependants (particularly since, if I understand your previous posts correctly you are also here on a Dependant visa, so you are actually looking to bring in an unemployed Dependant of an unemployed Dependant). I feel that if you have no choice but to live with your mother then you are going to need to do it in a country where you both already have the right to reside.

I am here on a work visa, not a dependant visa.

I was told by the few lucky ones that they had done it thru lawyers who build up a strong case on your behalf. Also, they say that immigration tend to be flexible in some cases.

I wanted to know the experience/options of few others before I decide my course of action.

<< I was also thinking it's a little strange to change from a dependant visa to a work visa is such short time. Besides the only reason to change would be if you are a dependant of a student.

Anyways aside from that I think the issue is more the fact your mother is not over 60/65. Being a non PR may play a big factor, but she is not old enough for the HK government to feel she can't take care of herself.

My experience is that the immigration officers at Wan Chai are sympathetic and understanding when they have some discretion (I could have hugged a couple of them) but in this case I think it is a no-hoper. Breaking one rule may be possible (but I doubt it), breaking two extremely unlikely.

The immigration officers at the airport are a completely different breed however.

Actually me and my wife use the same ID on geoexpat. My wife had posted the thread which you have mentioned.

Anyways, my wife has already got a job in the field of her interest, though the pay is not very exciting.

I think I will speak to some lawyer about my mother's VISA.
