I'm here on an employment visa, my girlfriend is only here on a tourist visa. Is it possible for me or her to start our own business so that she could legitimately work, essentially freelance, in the business? (we probably wouldnt have any intention of employing anyone else)

I am no expert but it is pretty doubtful under your current immigration status. There is couple option that I am aware of. One is to apply for the quality migrant program. The other is to try an investment visa (but that requires a reasonable amount of capital.)

Have you had a chance to check the various programs on the HK immigration office website? Maybe that will give you an idea.

Last but not least, you could always consult an attorney and see if they have some creative ideas.
