ABC Looking for advice in RTL Application

ABC Looking for advice in RTL Application

Hi, I'm an ABC born and bred from the states. From research through this board, I *think* that because:

(1) I was born before 1997 (before 1983 too)
(2) My HK-born father was a UK subject (of HK) during my birth in the USA, so I can gain ROA prior to 1997 by "inherting" this right

(3) I actually get RTL since I've been absent for more than 36 months.

Can somebody help me fill out form 145?

a) I should be applying under section 2(7) [person's not of chinese nationality who were permanent residents of HK prior to 1 Jul 1997] ..... right?

b) Nowhere on section 2(7) does it mention that I can apply as the CHILD of a parent who had ROA prior to 1 Jult 1997 .... is this okay?

c) What did everyone who has done this fill out for section 4, where it talks about period of ordinary residence in HK? I haven't ordinarily resided in HK! I was born and bred in the states!?!?!

d) What did everyone fill out for section 6, where you have to make a whole bunch of declarative statements? I cannot possibly declare 1 and 2 .... I'm not a Chinese citizen?!?!

Sorry two more questions:

1) What did everyone put for their address? An in-HK address or out of country address?

2) Did you have to schedule an appointment in advance to submit ROP 145 or did you just show up and submit?

under setion 2(7) you will only be able to get right of abode if you are under 21, and once you will attain the age of 21, you will lose your right of abode, you must apply again for verfification of your right of abode by cirtue of 7 years residence.

i suggest you if you already have RTL( right to land) then as soon as you will live for 7 years in HOng Kong, you will apply and quickly get your ROA.

Also i feel no difference in RTKL and Right of abode as long as you donbt commit any offence and dont cast the vote.
