| How to get an ID card / dependant visa to work in HK Dear all, I live here in HK (sent by a French bank) and my partner came to join me here. He has a UK passport and can stay up to 6 months in HK. But on a tourist visa he s of course not allowed to work. He has been offered different positions, but these employers don t want to apply for a work permit. As we are not married, is a wedding the best solution for him to be regular with the immigration policies ? Or can he obtain a dependant visa even if we re not married ? Or is there any other solution ? Thanks for your help |

| The only solutions are: - Dependant visa: for which he neds to marry someoneone who is a Permanent Resident or who has an Employment Visa - Employment Visa of his own - Capital Investment Entrant Scheme - invest about HK$7M in local assets - Investment Visa - start your own business here, with ImmD approving the business and investment plans (which must at least show plans to employ locals). |

| Yea, I heard bout problems tht employer doesnt want to apply work permit for foreigners becoz its a fuss to them. I think they only way ur bf can stay with u in hk is to get married n than he can apply dependant visa under ur employment status. There are some cases from this forum, ppl who r not legally married fail to get a dependant visa. |

| Thks for your replies. I think the easiest way is definitely to get married !!! But I d like to have more explanations on the "Employment Visa of his own". We downloaded the forme on the Immi Dpt website, but it appears that anyway there s a form to be completed by the employer with quite confidential information. So this does not make such a great difference compared to a work permit applied by the employer, does it ? Thks for your help ;-) |

| Employment Visas are always linked to a specific employment. Officially it is always the Employee who makes the application - the (potential) employer is simply the Sponsor and has to provide supporting documents. In practice many larger multinationals have HR departments who handle all the logistics of the application, but formally it is still the employee who makes it. |

| there are several papers need to submit by the sponsor company to immigration. Thats why some company did not wan to sponsor ur partner coz they might think its a fuss to them. They need to show immigration proof (eg: advertisements) that they cant find such a professional person like ur partner in hk inorder to get visa. |

| I'm not sure you've quite got it yet. There is only one person who can legally apply for an Employment Visa and that is the person who wants to be employed (the Applicant). In order to apply for such a visa the Applicant must have a Sponsor. That Sponsor must be the company which wishes to employ the person, and the Sponsor must provide documentation that shows good reason why they cannot find a permanent resident for the job. It is not possible to apply for an Employment Visa without a Sponsor, and if granted it is not permitted for the Applicant to work for anyone else except the Sponsor. In some cases larger multinationals have HR departments who assist the Applicant to fill in the necessary forms and deliver them to the Immigration Department. However, this makes no difference to the fact that the person who will be employed is formally the Applicant, and the potential employer is the Sponsor. |
