im looking to rent a property that is not thru a agent. how can i check that the property is really owned by that owner and that it is not under and morgage?

There is no law against the renting of your mortgaged property. It is only of concern if the owner is behind on payments as at some point the property will be sealed off and repossessed.

You can do a land record search to confirm who the owner is.
