| | | Over Stayed in Hong Kong - Visa Part 2 Quick background. Im the aussie idiot who forgot to go to china to reset his holliday visa. I acidently overstayed 2 months. The problem being that my father, aunti and uncle have planned a shopping trip to Hong Kong, Macau and China arriving on the 13th of september. If I tryed to go across the boarder I was afraid I would get stopped and interogated and be deported from there. I went to the immigration department today. The guy made me fill out a visa extention form for some stupid reason knowing full well that you cant get an extention when its already expired but i did what i was told. Ofcourse he came back 3 1/2 hours later with a letter states "having taken into consideration the information made available and all the circumstances of your case, i am not satisfied that you are seeking to extend your stay in hong kong for a genuine visit. Your application is therefore refused. You are required to report to general Investigation Section at blah time and blah date". They then took my passport and set a time for me to be investigated. My question is has anybody been though this ? What are they likely to do?
I know this is gonna sound hard to belive but i sold my business and most of my posessions to come and stay with my wife to be in hong kong. Ive slowly been living off my savings and been here many times before but this is the longest. Ive been here since feburary. They simply wont belive im on hollidays and refuse to belive i havent been working here and i really dont know how to convince them otherwise. Part of the reason why i forgot to renew the visa is because im getting married in december and have been planing it and my familys trip to here and had a major brain malfunction just like locking your keys in your car when you got a lot on your mind and your hands full of shopping. Can anybody tell me if they have been though this and with any great certainty what they might do? My worst nightmare is to be parted from my parter and even worse still refused entry back in any time soon : (

PS do i dress up fancy for the interrogation or like a tourist, im afraid if i look like i got to much money they might nail my balls to the wall for every penny but on the other hand i dont want to look like a bum who must have been working here some how to pay his way. | |

Don't worry .. they really don't give a rats arse about your funds. All they're concerned is with the fact that you've overstayed and if the reason for overstaying is legit or not. | |

Of course there is quite a possibility now that even if you were to marry her they might decline a Dependent Visa since you have demonstrated not being able to stick by the terms of the previous one. | |

You may then be refused entry for a period which can be two years. The fact that you are with your partner may help. They will treat you politely though. I have been involved in much worse cases than yours and it has gone OK so don't panic. | |

That is wrong - Immigration will grant an extension visa, even if you have overstayed. They need to issue the extension visa (costs about $135) for admin purposes.
If your wife is PR, get prepared, locate the original marriage certificate.
